KATA MAMBO GENERAL TERMS AND CONDITIONS OF SALE


Any booking made with Kata Mambo implies unconditional acceptance of the General Terms and Conditions of Sale and the terms of services and programs. Services and programs are clearly displayed and defined on the website:kata-mambo.com



Organizer's Responsibility:


  • Kata Mambo may cancel an activity or excursion if the minimum number of participants is not reached or due to force majeure (adverse weather conditions, transportation problems, breakdowns, strikes, etc.). In these cases, a full refund will be issued without additional compensation.


  • Kata Mambo accepts no responsibility for variations in weather conditions. No refunds, even partial, will be given for these reasons.


  • The presence of dolphins, being wild animals, cannot be guaranteed 100%.
  • Kata Mambo reserves the right to refuse last-minute boarding to passengers whose behavior is inappropriate or likely to endanger their own safetythat of other passengers or crew members: alcohol consumption, aggression, lack of listening and respect for safety instructions, etc...An entire private charter can also be cancelled for the same reasons.NO REFUNDS, EVEN PARTIAL, OR POSTPONEMENT OF THE OUTING WILL BE GRANTED.



Participant's Responsibility:


Cancellations made by the client more than 72 hours before the date of the excursion entitle them to a full refund.


If the client cancels between 48 and 24 hours in advance, they will be refunded 50% of the total price of the excursion. In case of illness or accident with presentation of a medical certificate, or in a justified case of force majeure, a full refund will be issued. This full refund applies only to the person affected by the justified cancellation (or one adult plus one child if it is the child who is affected).


Finally, in the event of cancellation by the client less than 24 hours in advance, no refund will be issued except upon presentation of a medical certificate. It is understood that a refund in case of illness, with supporting documentation, only applies to the sick person and not the entire group, except of course if the person is a minor, in which case an adult will be authorized to cancel their place and will be refunded. (Please note: only one adult is permitted.)




Participant's obligation:


Passengers must arrive at the Kata Mambo office no later than 15 minutes before the scheduled departure time indicated on their booking confirmation. After this deadline, boarding is not guaranteed.

Passengers are responsible for any damage caused by them or any person under their care to the ship, its facilities and amenities, other passengers, staff and third parties.


Weapons: Passengers are strictly prohibited from bringing firearms or bladed weapons, ammunition, explosives, fuel, or any other flammable substances on board, as well as any illicit products.


Minors:


Minors under the age of 16 on board the ship cannot travel alone. They must be accompanied by the person(s) with parental authority during the excursion.

They cannot move around the ship unaccompanied and must be constantly under the supervision of parents or any other accompanying person who has responsibility for them.


Under no circumstances will the company and/or the captain be held responsible for damages incurred by minors in violation of the above.


Security :


  • For everyone's safety, passengers are required to follow the instructions given by the crew on board the catamarans.


  • Drinks are available at the "open bar" on the boat; however, as alcohol should be consumed IN MODERATION, the captain (or any other member of the crew) reserves the right to prevent a passenger from drinking alcohol if deemed necessary for the safety of the passenger themselves or other passengers on board the catamaran.

Organizer's Responsibility:


Kata Mambo may cancel an activity or excursion if the minimum number of participants is not reached or for reasons of force majeure (unfavorable weather conditions, transportation issues, breakdowns, strikes, etc.). In such cases, a full refund will be provided without any additional compensation.


Kata Mambo accepts no liability for changes in weather conditions. No refunds, even partial, will be granted for these reasons.

The presence of dolphins, being wild animals, cannot be guaranteed 100%.


Participant's Responsibility:


In the event of a cancellation by the customer, fees will be withheld depending on the cancellation period: 50% of the total price for cancellations made between 72 and 24 hours before the excursion, and 100% for cancellations made less than 24 hours before. In case of a medical emergency, a medical certificate is required to avoid these fees.


Participant's Obligation:


Passengers must present themselves at Kata Mambo's office no later than 15 minutes before the boat's departure time indicated on the booking confirmation. After this time, boarding cannot be guaranteed.

They cannot move around the vessel unaccompanied and must always be under the supervision of a parent or guardian who is responsible for them.
